According to the legislation of the Republic of Belarus, topology of an integrated circuit means the three-dimensional layout of all the elements constituting an integrated circuit and their interconnections fixed on a physical medium.
The legal protection applies solely to topologies that are original.
A topology shall be original if it is the result of creative activity of the author. A topology is deemed original unless proved otherwise.
A topology, where totality of elements is commonplace among creators and manufacturers of integrated circuits at the date of its creation, shall not enjoy legal protection.
Topologies, which consist of the elements that are commonplace among creators and manufacturers of integrated circuits at the date of its creation, enjoy legal protection only if those elements taken as a whole meet the conditions of originality.
The legal protection shall not extend to any ideas, methods, systems or encoded information, which may be embodied in the topology.
A topology of integrated circuit shall be legally protected on the basis of its registration in the National center of intellectual property. The right to the topology of integrated circuit shall be protected by the State and attested by a certificate. The scope of legal protection will be determined by all the elements constituting an integrated circuit and their interconnections represented in depository materials.
Documents required for filing application* for registration of topology of integrated circuits:
- applicant(s) data;
- author(s) data;
- deposited materials;
- abstract;
- document confirmung payment of the fee;
- power of attorney.
The application for registration should be filed two years at the latest after the date of the first exploitation of the topology if there has been exploitation.
